OFFICE MEMORANDUM
Subject:Clarification on fixation of pay under Rule 7(2) of CCS(RP, Rules, 1986.
The Ministry of Finance have been receiving references from different Ministries/Departments pointing out that anomaly in fixation of pay had arisen on account of the fact that the pay of some Government servants in the non-functional selection grade in the pre-revised scale had been fixed at a a lower stage in the revised scale than what would have been fixed had he been in the ordinary grade. To rectify this anomaly, a suggestion,
has been made that Rule 7(2) of CCS(RP) Rules, 1986 which provides that subject to the provisions of Rules 5, if the pay as fixed in the officiating post under sub-rule (1) is lower than the pay fixed in the sub- stantive post, the former shall be fixed at a stage next above the substantive pay, may be invoked.
2.The matter has been examined in all its aspects. In view of the fact that ordinary Grade and Selection Grade posts are borne on teh same cadre, the question of treating the appointment in the Selection Grade as a case of officiating promotion does not arise.However in order to remove the anomaly mentioned in the case cited in the preceding para, it has been decided that the pay of the senior Government servant may be stepped up with reference to junior, subject to the fulfillment or the following conditions:-
(a) Both the senior and junior Government servant belong to the same cadre;
(b) The pay of a junior in Ordinary Grade has been fixed at a higher stage thatn the senior appointed in Selection Grade, and
(c) The senior had been drawing more or equal patent than the junior till the date of his appointed to S.G.
3.In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issues in consultation with the Comptroller & Auditor General of India.
