Notification-Amendment in fundamental rules 1974

NOTIFICATION
Subject:Notification-Amendment in fundamental rules 1974.
In exercise of the powers confered by the provision to aryicle 309 and clause (5) of article 148 of the constitution,and after consultation with the controller and auditor General in relation to persons serving in the Indian Audit and Accounts Department,the President hereby makes the following rules further to amend the fundamental rules,namely:-
(1)These Rules may be called the fundamental (fifth Amendment) Rules,1974.
(2)They shall be deemed to have <into Force on the Ist day of November,1973.
2. In the fundamental Rules,for the third provide so to F.R 22-0 the following provided so shall be substituted namely:-
“provided also that where a Government servant is,immediately before his promotion Or appointment to a higher post,drawing pay at the maximum of the time scale of the Of the lower post,his initial pay in the time-scale of the higher post shall be fixed at The stage next above the pay notationally arrived at by increasing his pay in respect Of the lower post by an amount equal to the last increment in the time scale of the
Lower post”.
Explanatory Memorandum: The rule is amended retrospectively since the pay commision’s recommendations contained in para 25 of chapter 8 of their report(VOL.I0,was accepted and announced by the govt.on 1.11.73 vide Resolution No.709340/73-Imp.cell dated 1.11.1973.the financial implication of giving this retrospective effect cannot be assessed as the amended rule will operate in respect of promotion upto class I level ocuring on or after 1.11.1973. the retrospection servant as the amendment is liberalising in nature.
