Dear Sir,

Sub: Payment of Leave Salary to the Running Staff after implementation 7th CPC recommendations-reg.

Ref:( i) NFIR’s PNM Item No 47/2018.
(ii) Railway Board’s letter No E(P&A)II/2017/RS-22 dated 28/12/2018 (RBE No.204/2018),

Kind attention of Railway Board is invited to NFIR’s PNM Agenda Item No.47 sent to Railway Board on 26/06/2018 wherein Federation requested to issue instructions to the Zonal Railways For reckoning 30% pay element on 7th CPC pay etc., for payment of leave salary in the case of Running Staff w.e.f. January,2016.The Railway Board have issued instructions vide No.E(P&A)II/2017/RS-22 dated 28/12/2018 for reckoning 30% pay element for calculation of leave salary (until further orders) on the revised Basic Pay in the 7th CPC Pay Structure.

In this connection, Federation desires to point out that the orders dated 28/12/2018 on the subject are incomplete and do not cover the relevant components for reckoning 30% pay element for calculation of leave salary of Running Staff Federation invites Railway Board’s attention to Para 3.23 (b) of Board’s instructions contained in letter No. E(P&A)II-80/RS-10 dated 17/07/1981 as laid down as under:-

“When Running Staff are on leave, they shall be entitled to be paid their leave salary based on their Basic Pay plus 30% thereof representing the pay element of Running Allowance and the other Allowances including Dearness Allowance/Addl. D.A. due on such basic pay plus 30% thereof”.

According to the above provision, Dearness Allowance/Addl. D.A, due on Basic Pay plus 30% thereof shall be the part of leave salary for Running Staff. This entitlement has not been incorporated in RBE No.204/2018 dated 28/12/2018. Reports also received from different Zonal Unions that DA was not calculated on pay plus 30% thereof, for payment of leave salary since the date of effect of 6th CPC pay structure. This situation necessitates issuance of clarification instructions.

NFIR, therefore, requests the Railway Board to issue amended instructions for calculation of DA on pay plus 30% thereof for payment of leave salary to the Running Staff with retrospective effect (i.e. w,e.f. 01/01/2006 on 6th CPC Basic Pay plus 30% thereof and w.e.f. 01/01/2016 on 7th CPC Pay plus 30% thereof w.e.f. 01/01/2016) respectively.
