7th pay commission proposal should be submitted to the implementation cell in two weeks – Confederation

MOST IMPORTANT

TO ALL AFFILIATED ORGANIZATIONS OF CONFEDERATION

Please read the following minutes of the Implementation cell of the Finance Ministry which is acting as the Secretariate of the Empowered Committee constituted by the Government under the Chairmanship of Cabinet Secretary for processing of 7th CPC recommendations for submission to the cabinet for approval. Please ensure (1) that your department has nominated a nodal officer and try to interact with him (2) that your organization has submitted a memorandum or letter to your departmental head seeking modifications to the department-specific recommendations of the 7th CPC (3) that your departmental head held consultations with your organization on the department specific modifications submitted by you, before finalizing the proposals for submission to the Implementation cell (4) that proposal as per the demand of your organsiation for modifying the proposal of 7th CPC is submitted to the Implementation cell within two weeks (i.e before 16.02.2016) by your department.

Please note that this is the only stage when the Unions/Associations/Federations in each department shall get an opportunity to present their demand for modifications on department – specific recommendations of the 7th CPC. If we fail to Intervene effectively at this state, we may not get another chance to present our case before the Government.

Regarding common demands JCM (NC) Staff side had already submitted its memorandum to Cabinet Secretary and two stages agitational programmes are organised and is preparing for indefinite strike. Regarding Department-specific issues Confederation National Secretariat held last month had given a clear direction to all affiliated organizations to organize departmental level agitational programmes by each organsations (if possible jointly with other organizations in that department) on department- specific modifications submitted to each Departmental head. Unless we build up pressure by organizing struggle the departmental heads may not consider our demand for modification seriously and may not even submit any proposal for modifications to the Implementation cell.

Please note the following decisions of the Implementation cell.

(1) Nodal officers to take net of any representation or demand of the staff side Association under the administrative purview of their Department. Nodal officers to ascertain the views/comments of the concerned office in the light of the representation/demands raised by the staff Association.
(2) In case, there is any need for consultation with the staff Association at the level of the Department, the same may be done as per the assessment of the Department.
(3) In case, the Department is of the view that any recommendation which are specifically related to their Department, need any modification, adequate justification in clear-cut terms should be brought out while sending the comments to the implementation cell
(4) In case of any modification, the extra financial implication (per annum) over the recommendations of the commission should be clearly indicated.
(5) If any modification is suggested approval of the Minster (of the concerned department should be obtained.

All the above formalities are to be completed within two weeks and proposal should be submitted to the implementation cell within two weeks i.e., before 16.02.2016.

    The MACP for non-gazetted administrative posts should be changed into Promotional Basis ATLEAST ONE POINT OF TIME AT THE LEVEL FROM GROUP-B NON-GAZETTED POST TO GROUP-B GAZETTED POST instead of just megre increase in grade pay. Many seniormost employees who have already put more than 20, 30, 40 years, because of non-availability of vacancy, they are still in the same designation (that means in the non-gazetted post only) by getting only minimum increase in the grade pay and retire without getting promotion to the next higher position in the gazetted post even though they are eligible for promotion to the gazetted level post. In a same group of employees, some will get regular promotion very early when vacancy arises and the remaining will be in non-gazetted post only for so many years for getting the promotion and they have to assist to their fellow friends of the same group and some will retire from the same post cursing their fate and the government.

    Hence, it is required that those who are at service and have completed minimum residency period in the present post, or ATLEAST THOSE WHO HAVE COMPLETED 20 YEARS OF REGULAR SERVICE FROM THE DATE OF PRESENT POST (I.E., FROM THE DATE OF BECOMING ASSISTANT/SR.STENOGRAPER IN GROUP-B NON-GAZETTED POST) they should be given promotion under MACP from Group-B Non-Gazetted Level to Group-B Gazetted Level.

    It is once again requested that those who have completed residency period in group-B (Non-Gazetted) should be moved to Group-B(Gazetted).

    My above comment relate to fixation of pension of pre-2016 retirees mentioned by 7 th cpc in paras 10-1-67 to 10-1-69 with two illustrations.Sub para I states that pension shall first be fixed in the pay matrix on the basis of payband and grade pay at the minimum of the corresponding levelin the pay matrix.The amount so arrived at shall be raised to arrive at the notional pay ,by adding number of increments earned in that level while in service at the rate of 3%. 50%of the total amount so arrived at shall be revised pension.
    Since the service rendered in the last post is less than one year,no increment can be drawn.The implementation committee may kindly consider and do the needful to those who retired in the last post without getting increment.

    Individuals who have been promoted at the fag end of their carrier are bound to get lesser pension than those who were junior but were not promoted,if present recommendations of 7 th cpc are accepted.
    Fot instance ,though I served 40 years meritorious Govt service from 1954 to 1994,i got promotion to higher post in September 1993. and retired on superannuation on attaining the age of 58 on 30-04-1994.Similarly there are so many officials retired like this and earning less pension than their juniors..The implementation committee may kindly and sympathetically consider in receiving some monetary benefit by those retirees and recommend to the cabinet.

    I am to suggest the following modification to the recommendation for pension formulation for civil employees who retired before 01-01-2016 contained in para 10.1.67 i)(chapter10.1) of the report of seventh CPC,so as to bring the spirit of the view of the commission that” the issue of parity in pensions is extremely important” in para 10. 1. 54 of the report ibid to effect. Suggestion: Modify second sentence of para 10. 1. 67 i) as follws.”This amount shall be raised to arrive at the notional pay of the retiree by adding the number of increments, to be determined with reference to the pay drawn by he/she while in service at the rate of three percent”” This modificaton is required to protect the interests of retirees,whose pay was fixed at higher stage on promotion to higher scale of pay/level before retirement.
