Sub: Non-payment of HRA, Transport Allowance etc., to trainees appointed on compassionate grounds in Grade Pay 1900/- in artisan category etc-reg.
Ref: Railway Board’s letter No. E(NG)IV 1998/RC-1/64 dated 14/09/12012
NFIR desires to invite kind attention of the Railway Board to letter dated 1410912012 wherein Board in Para 3(i) have clarified as follows:
“A person appointed as ‘Trainee’ enjoys the status of a Government servant from initial day and will be allowed all the allowances and benefits allowed to a Government servant.“
Federation also wishes to convey that the above instructions have been issued by the Railway Board consequent to clarifications issued by the DoP&T vide OM No. F.No. 140141212009-
Estt(D) dated 3’d April2012 circulated to all ministries including Railway Ministry and applicable to all “Trainees” irrespective of the appointment of the “Trainee” in the particular Grade Pay including the appointments made on compassionate grounds.
It has since been reported to NFIR by one.of its affiliate WRMS that on Western Railway, the “Trainees” appointed on compassionate grounds in GP 1900/- as Technicians etc., in Electrical, Mechanical Departments and in the Workshops are denied payment of allowances like HRA & Transport Allowance on the wrong plea that the Board’s instructions dated 1410912012 are applicable only to the compassionate appointees in GP 1800/-, ignoring clear cut provision in para 3(i) as mentioned above
In this connection, NFIR desires to state that due to incorrect interpretation by the Western Railway, all compassionate appointees in GP 1900/- have been put to serious financial hardships, even though their entitlement is fully covered by the instructions of Railway Board issued under letter dated 14/ 09 /12012.
Federation has also come to know that when the issue was raised by our affiliate – WRMS at GM’s level, the Zonal Railway instead of making payment of HRA, Transport Allowance to these trainees in GP 1900/-, made a reference to the Railway Board vide letter No. E/P&AA{iscAVRMS(L) dated 22/07/2014, seeking clarification. Federation requests that the said reference may please be connected. Federation also feels that similar situation might be prevailing other Zones.
In view of above, NFIR requests the Railway Board to kindly issue suitable clarificatory instructions to Western Railway and equally to all Zones, PUs etc., to avoid hardships faced by the staff due to misinterpretation of extant instructions. A copy of the instructions issued may please be endorsed to the Federation.
