OFFICE MEMORANDUM

Subject:- Grant of Disability Leave under rule 45 of CCS(Leave) Rules, 1972 to the victims of the recent Mumbai bomb blast.

The Department of Personnel & Training have been considering grant of Special Disability Leave to the Central Government employees who have been injured/disabled during the recent Mumbai Bomb blast occurred on 11th July, 2006.

2. In terms of Rule 45 of CCS (Leave) Rules 1972, special disability leave may be granted to a Govt. servant (permanent or temporary) who is disabled by injury accidentally incurred in, or in consequence of, the due performance of his official duties or in consequence of his official position, or by illness incurred in the performance of any particular duty, which has the effect of increasing his liability to illness or injury beyond the ordinary risk attaching to the civil post which he holds. The Special Disability leave is granted subject to the fulfillment of the conditions in the rule.

3. Keeping in view the seriousness of the recent Mumbai bomb blast, consequent upon which certain Central Government employees while returnirig their homes after due performance of their official duties have also been injured/disabled during the incident, it has been decided that the provisions of rule 45 of CCS(Leave) Rules, 1972 may be extended to such Central Government employees on humanitarian grounds, in relaxation of rule, subject to fulfillment of all the conditions laid down in the said rule.

4. In so far as the persons serving in the Indian Audit & Accounts Service are concerned, orders will be issued after consulting the Comptroller & Auditor General of India.
