Subject: Implementation of judgment of Hon’ble Supreme Court in Civil Appeal Nos.6046-6047 titled “Rohtas Bhankhar vs.UOI” Modification of results of SO LDCE 1996 – Consequential Benefits -Fixation of pay – regarding.

The undersigned is directed to refer to this Department’s OM No.6/9/2014-CS-I(S) dated 21.07.2015 and 11.09.2015 vide which 33 officers (8 appellants and 25 non-appellants), who figured in the modified results of SO LDCE, 1996 declared by UPSC in compliance with the above judgement, were included in Select List for the year 1996 in the Section Officers’ Grade of CSS against Examination Quota.

2. The matter regarding manner of fixation of pay in respect of these officers upon their inclusion in SO SL 1996 against Examination Quota was under consideration in this Department. It has been decided, in consultation with Establishment Division of this Department, that the pay of these officers may be fixed notionally with effect from 19.08.1998, the date of joining of the immediate senior to these officers i.e. Shri M. Jayachandran (Rank No.71) The pay fixation is allowed on notional basis with actual benefits from the date these officers officiated as Section Officer or Private Secretary, as the case may be.

3. Upon their inclusion in SO SL 1996, they become eligible for grant of Non Functional Scale on completion of four years of approved service w.e.f. 01.07.2000 in terms of OM No. No.21/36/03-CS.I dated 13.11.2003 and OM No.5/4/2005-CS.I dated 25.01.2006. Their pay in Non-Functional scale is to be fixed notionally we.f. 01.07.2000 with actual benefit w.e.f. 03.10.2003.
