OFFICE MEMORANDUM

Subject : – Central Civil Services (Revised Pay) Rules, 1973 – Fixation of pay of Government Servants who opt for the revised scale of pay from a date subsequent to 1.1.1973.

The Third Pay Commission had recommended a special pay fixation formula for fixation of pay in the revised scales as on 1.1.73. On a representation from the Staff Side (JCM), Government, vide this Ministry’s O.M.No.67/II/1/73-IC dated the 17th May, 1974, decided that the benefit of the special pay fixation formula may also be allowed to persons who elect to come over to the revised scales from a date subsequent to 1.1.73 but not later than 31.12.74 in respect of posts held by them on 1.1.73. This time limit was further extended to 31.12.75 vide this Ministry’s O.M. No.60/17/IC/78 dated the 29th September, 1978 on the basis of representation made by the Staff Side (JCM) that opting for the revised scales upto 31.12.74 had not done full justice to the employees.

2. The Staff Side in the National Council (JCM) had made/demand that time limit for opting for the revised scale of pay from a date subsequent to 1.1.73 may be extended further beyond 31.12.75 to rectify the anomalous position that still existed in several cases. The matter has been considered. An agreement has reached in the Committee of the National Council (JCM) that the time limit for opting the revised scales of pay may be extended upto 31.12.79 and the employees may be allowed time upto 31.5.84 to exercise fresh option.

3. Accordingly, the President is pleased to decide that the pay of Central Government employees who opt to come over the revised scales of pay from a date not later than 31.12.79 in respect of posts held by them on 1.1.73 may also be fixed under the provisions of Rule 7 of Central Civil Services (Revised Pay) Rules, 1973. The employees who want their pay to be fixed in the revised scales from a date not later than 31.12.79 may be allowed time upto 31.5.1984 to indicate their option in regard to the date from which they want their pay to be fixed in the revised scales. However the pay of employees who exercise their option for the revised scales with effect from any date subsequent to 31.12.1979 shall be fixed in those scales under Rule 9 (of the rules) ibid.

4. In so far as persons serving in Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.
