OFFICE MEMORANDUM

Subject: Regulation of pay in the prescribed scale in cases where two or more existing scales have been replaced by a single prescribed Scale.

The Undersigned is directed to say that there have been instances of two or more existing scales having been replaced by a single prescribed scale under the central civil service (Revision of Pay) Rules, 1947 and in some cases the officiating pay of the individuals concerned has been refixed in the prescribed scale with reference to the pay in one of the higher existing scales. A question has been raised as to whether the pay in the prescribed scale should be refixed from the date from which such a person would have reverted to a lower existing scale. But for the introduction of the new pay scales. After a very careful consideration it has been decided that pay of individuals need not be refixed on the occasion of their constructive reversion mentioned above. Thus the pay fixed with reference to officiating pay will be treated as substantive pay for all purposes.

2. These orders will have effect in individual cases from the data from which they have elected the prescribed scales.

3. In so far as Government servants serving in the India Audit and Accounts Department are concerned these orders are issues after consultation with the comptroller and auditor general.
