Dear Sir,
Sub: Implementation of recommendations of 7th CPC relating to grant of Hospital Leave, Special Disability Leave and Sick Leave-reg.
Federation invites kind attention of the Railway Board to Para 9.2.37 of the report of 7th Central Pay Commission wherein the Pay Commission while subsuming the Hospital Leave, Special Disability Leave and Sick Leave into a new leave named Work Related Illness and Injury Leave (WRIIL) has made following recommendations:-
(i) Full Pay and Allowances will be granted to all employees during the entire period of Hospitalization on account of WRIIL.
(ii) Subsequently, beyond hospitalization upto 12 months, the employee is entitled for half Pay plus Allowances with the proviso that the period of half pay leave may be commuted on submission of medical certificate by the employee.
(iii) In case of employees governed by Workmen’s Compensation Act, 1923, the amount of leave salary payable under WRIIL shall be reduced by the amount of compensation payable under the Act.
(iv) No Earned Leave or Half Pay Leave will be credited during the period the employee is on WRIIL.
Federation is constrained to bring to the notice of Railway Board that though the report of the 7th CPC has been accepted by the Government about 2 years 9 months ago, instructions relating to Work Related Illness and Injury Leave (WRIIL) have not been issued by the Railway Board.
NFIR, therefore, requests the Railway Board to implement VII CPC recommendation and issue suitable instructions to the General Managers. The existing Leave Rules contained in Chapter 5 of Indian Railway Establishment Code Vol. I, 1985 Edition (Third Re-print Edition) — 2008 may also be amended accordingly. Copy of the instructions issued may be endorsed to the Federation.
