Clarification on Fees of Retired Railway Officers as Arbitrators

The Government of India’s Ministry of Railways, Railway Board, has addressed a communication (No. 2020/CE-I/CT/ARB/2E) dated 22nd August 2023 to the General Manager of South Eastern Railway. This communication pertains to the issue of fees for retired railway officers serving as arbitrators. The South Eastern Railway had submitted a request to exclude the period from 15th March 2020 to 28th February 2022 from the calculation of time limits for various actions during arbitration proceedings. This includes determining the time taken to publish awards and making corresponding payments of an additional 50% fee to the arbitrators.

Ref: South Eastern Railway’s letter No. RS/ARB/Policy dated 16.08.2022

South Eastern Railway, vide their letter under reference, has sought exclusion of period from 15.03.2020 to 28.02.2022 for working out time limit prescribed for different actions during arbitration proceedings, including working out time taken for publishing of award and corresponding payment of 50% additional fee to Arbitrators.

2. South Eastern Railway’s proposal has been examined and it is advised that vide letter No. 2009/CE-I/CT/14/Main dated 09.04.2021, Board’s decision to exclude the period from 25.03.2020 to 31.05.2020 (i.e. period of first lock down), while working out time limit prescribed for different actions during arbitration proceedings including working out time taken for publishing of award and corresponding payment of 50% additional fee to Arbitrators, was conveyed to Zonal Railways. Further, in order to deal with the situation of lockdown, Board vide letter No. 2020/CE-I/CT/ARB/2E dated 08.12.2020 had also allowed the Arbitration hearing through Video Conferencing. As such, further necessary action on the matter may be taken by South Eastern Railway in terms of these instructions only.

3. This issues with the concurrence of the Finance Directorate of Ministry of Railways.
