Sub: Claims, regarding payment of Travelling Allowance to the staff promoted under cadre restructuring w.e.f. 01/11/2013 — case of North Western Railway-reg.
Ref: (i) NFIR’s letter No. 1/5 (F) dated 01/03/2016.

The Railway Board had conveyed vide reply dated 27/06/2016 that since the pay fixation as a result of cadre restructuring and consequent promotion, do not involve actual change of duties, as such in terms of Rule 1602 (2) of IREC Vol. II, no revision of claims for TA already settled was permissible. The decision communicated by the Railway Board, being illogical and unreasonable, the Federation re-iterates the following points:-

• Railway Board have deliberately ignored the contents/stipulations contained in the footnote of the codal provision, which fully cover the cases of staff promoted under cadre restructuring and do not stipulate the condition of actual change of duties.
• Since the Railways took abnormally long time in the implementation of cadre restructuring decision with retrospective effect from 01/11/2013, the employees who got higher Grade Pay cannot be deprived of T.A., payments when they preferred claims on the basis of their Grade Pay/Pay Band.
• When the arrears of pay and allowances, consequent upon revised pay have been allowed, the arrears claim of Travelling Allowance on the revised pay cannot be denied.
The above points clearly establish that the demand raised in the Zonal PNM meeting by our affiliated Union (UPRMS) is fully covered under the rules.
NFIR, therefore, requests the Railway Board to re-consider its decision and issue instructions to the North Western Railway to allow payment of arrears of TA duly endorsing copy to the Federation.
