OFFICE MEMORANDUM

Subject: Fixation of pay of re-employed pensioners-terms and conditions thereof.

The undersigned is directed to refer to this department’s Office Memorandum No.Fin(C)B(7)10/84 dated 1st December,1988, Fin-C-B(7)-10/98 dated 8th September, 1999 and Fin(C)B(7)13/2009 dated 19th April, 2010 on the subject cited above and to say that consequent upon the grant of re-employment to the state Government employees, the proposals for vetting of terms and conditions of such re-employment are sent to Finance Department by the Administrative departments. The matter relating to delegation of power to the Administrative Departments to settle terms and conditions of re-employment was engaging attention of the government for some time past. It has been decided that after the proposals for grant of re-employment are approved by the Finance Department and the competent authority, the terms and conditions of such re-employment will be decided by the respective Administrative Departments on the following lines:-

1. Salary His/her pay shall be fixed in accordance with the provisions of H.P. State Civil Services (Fixation of Pay of re-employed pensioners) Orders, 1988 circulated vide Finance Department OM No. Fin(C)B(7)10/84 dated 1st December, 1988, O.M. No Fin-C-B(7)-10/98 dated 8th September, 1999 and with O.M. No. Fin(C)B(7)13/2009 dated 19th December, 2010 or as amended from time to time.
2. Tenure The tenure of appointment shall be for a period as determined by the Government and will be effective from the dated of issue of the orders of re-employment.Provided that the Government can terminate this appointment even before the expiry of the above period by giving notice of one month in advance or paying one month’s salary in lieu of notice of one month in case the conduct and performance of the incumbent is not found satisfactory or if the Government decides to fill up the post, in question, by regular appointment, as the case may be.
3. TA/DA: He/She  shall be entitled to TA/DA as was admissible to him before his re-employment.
4. Leave The provisions of CCS(Leave) Rules, 1972, shall not be applicable to the re-employed person and he/she will also not be entitled to LTC/HTLTC facility. However, he/she will be entitled to one casual leave for each completed month.
5. Medical Facilities He/She shall be to avail medical facilities and grant of re-imbursement of Medical Expenses as is admissible under the relevant rules/instructions of the State Government.
6. Residential Accommodation He/She shall be entitled to the allotment of Government residential accommodation, if the accommodation is available or otherwise he/she will be entitled to receive House Rent Allowance as per State Government rules and instructions, in this regard.
7. Gratuity and Death- cum- Retirement Gratuity He/She shall not be eligible for Gratuity and Death-cum-retirement Gratuity for the period of said re-employment.
8. Other facilities He/She shall be entitled to the allowances as were admissible to him before his re-employment or as admissible for the post against which he has been re-employed. There will be no enhancement in salary on re-employment.

The proposal may be referred to the Finance Department, IF AD wants to insert conditions other than the above mentioned conditions or wants a modification in the same.
