Subject:- Protection / fixation of pay on appointment from one department to another department – clarification thereof.
Sir,
I am directed to invite a reference to this department letter No. Fin(C)B(7)-1/2004 dated 25th September, 2012 on the subject cited above and to say that as per provisions contained therein, employees who have been appointed by direct recruitment from one Government department to another department or PSU/ Boards/ Autonomous bodies/ Universities etc. And vice versa and are in receipt of higher grade pay in their parent organizations, have been granted protection of pay and allowed the grade pay of the post against which they are appointed with the condition that if their grade pay is higher in the previous department/ organization, the difference of grade pay is to be added in the pay in the pay band of such incumbents.
References are being received from various quarters seeking clarification on the issue. The matter has been re-considered and it has been decided that in case of an official working in higher pay scales/ grade pay in the parent cadre as a result of grant of benefits under ACPS, the higher pay scale/ grade pay being drawn by such employee shall be protected on appointment to another department, as a measure personal and the difference need not be added in pay in the pay band. The above referred OM may be deemed to have been modified to this extent.
