ORDER
Government vide order read as 1st paper above has implemented National Pension System (NPS) to all employees who are appointed on or after 01.04.2013 and who would have been governed by Part III of KSRs otherwise. Later government allowed mobility to those Government Servants/Autonomous Body employees/Aided Institution employees who are appointed in substantive vacancies on regular basis on or before 31.03.2013 and who were in such posts on 31.03.2013 and to whom the KSR, Part III Pension Scheme applies in their respective institutions. This mobility is not applicable in the case of part time contingent employees since their service benefits come under the purview of part time contingent employees rules. The honourable high court in the judgement read above has set aside the direction of Government not to include part time contingent employees of High court in the ambit of G.O read 2nd above and directed to pass new orders in the light of the observation made in the judgement. Even though Government Order read 2′ above, is not applicable to .the Part Time Contingent Employees who are promoted to the. post of Full Time Employees on or after 01.04.20 13 , in order to comply the judgement Government are pleased to include the petitioners in WP(C)No.12341/15 in. the statutory pension scheme.
Thus the judgement is complied with.
