Minutes of the meeting held under the chairmanship of Shri Saniav Kothari, Secretary, DOP&T on 31/08/2015 to consider the cases of inter cadre deputation/inter cadre transfer requiring relaxation of provision(s) of the guidelines.
A meeting was held on 31/08/2015 under the Chairmanship of Secretary(P) to consider the cases of inter cadre deputation/ inter cadre transfer requiring relaxation of provision(s) of the guidelines. The members of the committee E0 & AS and AS(S&V) were also present. Besides Dir(AIS) & US(S-II) were also present to assist the Committee in the meeting;
The Committee took note of the Action Taken Report on the minutes of the previous meeting held on 31/07/2015.
The Committee thereafter took the fresh cases and after detailed deliberations and careful consideration in each case, took following decisions in the meeting:-
Case No. 1: Inter cadre transfer of Ms Umamaheswari R., IAS(UP:2013) from Uttar Pradesh cadre to Madhya Pradesh cadre on the grounds of marriage with Shri Frank Noble. A, IAS(2013 batch).
The Committee was informed that the proposal of cadre transfer of Ms Umamaheswari R., IAS(UP:2013) from Uttar Pradesh cadre to Madhya Pradesh cadre on the grounds of marriage with Shri Frank Noble. A, IAS(2013 batch) is covered under the rules. The comments of the concerned State Governments have been sought and are awaited. The Committee “agreed” in principle for the proposal and directed that after receipt of the comments of both the State Governments and the vigilance clearance, the proposal may be put up for the approval of Secretary (P) through
EC & AS.
Case No. 2: IAS (Cadre) Rules — 1954, Inter cadre transfer of Ms Aanchal Sood, IAS(UK:2014) from Uttarakhand cadre to Maharashtra cadre on the grounds of marriage with Mr. Nimit Goyal, IPS, 2014 batch.
The Committee was informed that the proposal of cadre transfer of Ms Aanchal Sood, IAS(UK:2014) from Uttarakhand cadre to Maharashtra cadre on the grounds of marriage with Mr. Nimit Goyal, IPS, 2014 batch is covered under the rules. The comments of the concerned State Governments have been sought and are awaited. The Committee “agreed” in principle for the proposal and directed that after receipt of the comments of both the State Governments and the vigilance clearance, the proposal may be put up for the approval of Secretary (P) through EC & AS.
Case No. 3: Inter cadre transfer of Shri Ram Chandra Raiquru, IPS (BH:2013) from Bihar cadre to Uttarakhand cadre on the ground of marriage to Ms Ranjana, IAS, Uttarakhand cadre.
The Committee observed that Shri Ram Chandra Rajguru an IPS officer of Bihar (also his parent cadre) earlier applied for cadre change on the basis of marriage from Bihar Cadre to Uttarakhand cadre. The Government of India, Ministry of Home Affairs through communication No. I-11014/10/2014-IPS.IV dated 15/12/2014 informed that the cadre change of Shri Ram Chandra Rajguru was denied due to declining of “No objection” by the Government of Bihar.
The Committee observed that the present request is from his wife Ms. Ranjana, IAS (Uttarakhand cadre). As such the committee desired to seek further clarification from MHA (being the cadre controlling authority of IPS).
Case No. 4: Cadre Change of Ms K Radhika Aivar, IASIWB:111from West Bengal cadre, on the basis of PH(Physically Handicapped) policy dated 14.02.2014
The Committee observed that the preferences given by the officer are Rajasthan, Madhya Pradesh and Haryana. In terms of the extant guidelines, the comments of only state Government of Haryana were sought. However, the State Government of Haryana has denied “no objection” for the proposed cadre change. The officer has now requested to seek the consent of the State Government of Uttarakhand, the closest State to Delhi in terms of distance.
The Committee was informed that the comments of State Government of Uttar Pradesh have been sought for and are awaited.
Case No. 5: IAS (Cadre) Rules — 1954, Cadre change of Shri Raiesh Singh, IAS (AM:071 from Assam — Meghalaya cadre, on the basis of PH policy dated 14/02/2014
The Committee was informed that “no objection” from the State of Jharkhand has been received while comments from State Government of Uttar Pradesh and West Bengal are yet to be received. The Committee decided that on the request for the cadre transfer of the officer from Assam Meghalaya cadre to Jharkhand cadre, ACC note for the proposal may be put up.
CASE No. 6: Cadre change of Shri Dhaval Jain, IAS(WB:14)from West Bengal cadre, on the basis of PH policy dated 14/02/2014.
The Committee was informed that “no objection” from the State of Haryana has been received while comments from State Government of Rajasthan and Madhya Pradesh are yet to be received. However, no objection from his parent cadre of West Bengal is also not yet received. The Committee decided that on the request for the cadre transfer of the officer from West Bengal cadre to Haryana cadre may be put up after receipt of no objection from State Government of West Bengal.
Case No. 7: Inter cadre deputation of Dr Adapa Karthik, IAS(PB:08) from Punjab cadre to AGMUT Cadre (Chandigarh Administration) for appointment to the post of Secretary (Below Super Time Scale) in Chandigarh Administration.
The Committee observed that the present case does not fall under inter cadre guidelines and is rather governed by Administrative arrangement flowing out from the Punjab Reorganisation Act, 1966. Such deputations have been considered as being of administrative nature and there has been a convention to allow such deputations in relaxation of the existing inter cadre deputation guidelines.
The Committee therefore, decided to seek approval of competent authority after receipt of necessary clarification from MHA.
Case No. 8: Proposal for Inter cadre deputation of Shri Baldeo Purushartha, IAS (P6:20021 from Punjab Cadre to AGMUT cadre (Chandigarh Administration) for a period of 3 years.
The Committee observed that the present case does not fall under inter cadre guidelines and is rather governed by Administrative arrangement flowing out from the
Punjab Reorganisation Act, 1966. Such deputations have been considered as being of administrative nature and there has been a convention to allow such deputations in relaxation of the existing inter cadre deputation guidelines.
The Committee therefore, decided to seek approval of competent authority after receipt of necessary clarification from MHA.
Case No. 9: Inter cadre deputation of Smt Damyanti Dohre, IAS (UP) from Uttar Pradesh cadre to Uttarakhand cadre
The Committee considered the case of the officer and observed that it is not a case of inter cadre deputation but it is the case of overstayal without the approval of competent authority. The Committee directed that the officer may be asked to report back to her parent cadre immediately.
CASE No. 10:Inter cadre deputation of Shri Aiav Yadav, IAS(TN:10) from Tamil Nadu cadre to Uttar Pradesh cadre
The Committee observed that the proposal of the officer that the officer being of 2010 batch has not completed required nine years’ service in his parent cadre. The proposal was earlier not recommended by the Committee in its meeting held on 14.01.2015 and the case was again put up in the Committee meeting dated 02/07/2015 wherein it was decided by the Committee again not to recommend the case of the officer. The case has been again received vide PMO ID No. 600/31/C/03/2015-E.S-2(V.2) dated 25/08/2015. The Committee reiterated that the proposal is not covered under the policy and directed to incorporate the case in the quarterly report to be submitted to ACC immediately.
CASE No. 11:Inter cadre deputation of Shri Pradeep Kumar Jha, IAS (MN:06)from Manipur Tripura cadre to Bihar Cadre on grounds of extreme hardship
The Committee observed that the officer being of 2006 batch has completed required nine years’ service in his parent cadre. The officer has not reached Super Time Scale. The proposal for inter cadre deputation to Bihar is prima facie covered under the extant guidelines of inter cadre deputation. The Committee directed that the comments of all the concerned State Governments may be called for with a copy marked to the officer.
