OFFICE MEMORANDUM

Subject:- Fixation of pay under the Central Civil Services (Revision of Pay) Rules, 1947.

Under the Central Civil Services (Revision of Pay) Rules, 1947, all post-1931 entrants have to come over to the scales prescribed under these rules except where an individual elects to retain any particular existing scale by virtue of provision to rule 3(b). similarly a pre-1931 entrant holding a post to which rule 4 of those rules applies should come over to the prescribed scale in respect of such post. In both the cases, the individuals concerned have the option of coming over to the prescribed scales from one of the two dates mentioned in rule 6 and this option has to be exercised within the period specified for the purpose. A question has been raised as to how the pay of such as person should be fixed, if he fails to exercise the necessary option within the specified period. As the prescribed scales take effect from the 16th August, 1947 at the latest, the undersigned is directed to say that in these cases the pay of the individual concerned should be fixed in the prescribed scale, as if he elected the prescribed scale with effect from the 16th August, 1947.

It has also been decided that all Government servants whose services terminated, owing to one reason or other, after the 16th August 1947, and who did not exercise their option under the Central Civil Services (Revision of Pay) Rules, 1947, while in service, should be paid the arrears of pay and dearness allowance pertaining to the period from the 1st January, 1947, onwards only if the person concerned (or in the case of a person who has died, his legal heir) applies for in writing before the last date for electing the prescribed scale of the particular post. If the claim is made after the last date of election, only the arrears pertaining to the period from the 16th August, 1947, onwards should be paid in all cases except in the case of a pre-1931 entrant who was holding a post to which rule 4 of the Central Civil Services (Revision of Pay) Rules, 1947, did not apply. The provision of this para do not authorize payment of arrears of pay and dearness allowance in respect of service rendered under the Pakistan Government by a person who provisionally opted for the Dominion and came over to India after partition. These provisions also do not apply in the case of persons who opted for Pakistan and whose service terminated as a result of the option.
