Sub: Railway Services (Revised Pay) Rules, 2008 – Fixation of pay on promotion in 6th CPC Pay Structure – Deprival of annual increment to those promoted prior to 31/12/2005, but relieved after 01/01/2006-reg.

Federation invites kind attention of the Railway Board to the Railway Services (Revised Pay) Rules, 2008 circulated vide endorsement dated 04/09/2008. Para 2 of the above communication lays down that the revised pay structure to take effect from 1st January, 2006. These instructions vide Para 3 (iii) provide that there shall be a uniform date of increment i.e. 1st July of the year after implementation of the revised pay structure, citing example that the date of next increment of those employees which falls on 01/01/2006 will be given next increment in the revised pay structure on 1st July, 2006.
A number of cases have been brought to the notice of the Federation by its affiliated Unions that the staff who were given promotion in November/December, 2005 involving shifting of their place of duty but were not relieved to join promotion post on Administrative account and had actually joined the post after 01/01/2006 or on later date, were put to serious disadvantages as they were deprived of annual increment in the higher post on 1st July, 2006 and in their case the annual increment was granted only on 1st July, 2007. This reveals that such staff had undergone an un-imposed penalty of withholding of increment for one year. The concerned staff submitted representations to the Zonal Railways etc., but unfortunately their grievance has not been addressed in proper perspective. This financial loss to the staff, has caused further financial setback at the time of implementation of the recommendations of 7th Central Pay Commission and retirement on superannuation.
NFIR, therefore, requests the Railway Board to kindly consider the above negative development and issue orders to treat those promotions ordered prior to 31/12/2005, but given effect after January, 2006 due to administrative reasons to give effect from the date of issuance of the same for mitigating the hardship caused to the staff.
