Dear Sir,

Sub: Denial of minimum pay of the pay band (VI CPC) to the Senior Nursing Superintendents (Nursing Sisters) on Railways-reg.

Ref: (i) NFIR’s PNM Item No.13/2019.
(ii) NFIR’s letter No.III/SECRMC/4 dated 09/12/2019.
(iii) NFIR’s letter No. P2/2019 dated 19/03/2020.

Kind attention is invited to NFIR’s pending PNM Agenda Item No 13/2019 on the subject (sent to Railway Board on 29/05/2019) and letter dated 19/03/2020 to which there is no response, though over 19 months have passed.

2. In this connection, Federation invites kind attention of the Railway Board to the instructions issued by the MoF vide OM dated 28/09/2018, circulated vide RBE No. 158/2018 dated 12/10/2018, if interpreted correctly in the following manner, the situation of hardships and injustice caused to seniors as highlighted in PNM Agenda Item No. 13/2019 can be mitigated.

(i) Railway Board vide RBE No.158/2018 dated 12/10/2018 (circulated the OM dated 28/09/2018 issued by the Ministry of Finance — Para 8) decided that the entry of direct recruits appointed on or after 01/01/2006 when compared with the pay of Central Government employees appointed to such posts prior to 01/01/2006 on refixation in the revised pay structure under Rule 7 thereof found to be lower than the prescribed entry pay of direct recruits of that posts, shall not be less than such entry pay w.e.f. 01/01/2006.

(ii) The MoF’s decision further stipulates that likewise, the pay of Central Government employees who were appointed to such posts by way of promotion on or after 01/01/2006 and whose pay as fixed under Rule 13 of CCS (RP) Rules, 2008, happens to be lower than the said entry pay, shall also not be less than such entry pay from the date of their promotion taking place on or after 01/01/2006. The Federation re-emphasize that the later part of Para 8 of MoF’s OM dated 28/09/2018 (vide item ii above) covers fully the case of Sr. Nursing Superintendents (formerly known as Nursing Sister) working in Railway Hospitals/Health Units.

NFIR, therefore, once again requests the Railway Board to consider the above merits and issue instructions to the Zonal Railways and Production Units to allow pay re-fixation at the minimum of the scale i.e. Pay Band-2 and GP 4800 as on 01/01/2006 or from the date direct recruitee junior joined and got promotion to the post of Nursing Sister whichever is earlier. A copy of the instructions issued may be endorsed to the Federation.
